Can we put a ladder on next door’s land?

Advice from chartered surveyor John Conlin helps a couple who need to put a ladder on a neighbour’s land.

Question

My husband is planning to repaint the outside walls of our house. There is such a narrow strip (about 2 feet) between the side wall and boundary fence the ladder would be too steep for safety. 

Our neighbour has refused to allow the ladder on his side of the fence. Is there anything we can do?

Answer

Sadly such uncooperative attitudes are sufficiently common for Parliament to provide the solution. The ‘Access to Neighbouring Land Act 1992’ gives County Courts power to issue Orders require access for maintenance. 

The Act is not widely known but non-cooperative owners made aware of the prospect of a County Court Order generally change attitudes. Download the Act and show it to your neighbour.
